By accessing or using Speakera ("Platform"), operated by Speakera LLC ("Speakera," "we," "us," or "our"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree, do not use the Platform.
Speakera is an online marketplace that connects keynote speakers with event organizers. We facilitate bookings, payments, and communications but are not a party to the agreements between speakers and event organizers.
You must be at least 18 years old and legally capable of entering into binding contracts to use the Platform.
You must provide accurate, current, and complete information during registration. You are responsible for maintaining the confidentiality of your account credentials.
Speakers: Create profiles, set availability and fees, respond to booking inquiries
Event Organizers: Search speakers, submit booking requests, manage event details
Speakers are responsible for the accuracy and completeness of their profiles, including bios, photos, videos, speaking topics, and fee ranges.
You retain ownership of content you submit but grant Speakera a worldwide, non-exclusive, royalty-free license to use, display, and promote your content on the Platform.
You may not post content that is:
False, misleading, or fraudulent
Defamatory, obscene, or offensive
Infringing on intellectual property rights
Violating any applicable laws
Event organizers submit booking requests through the Platform. Speakers may accept or decline requests. A binding agreement is formed when both parties agree to terms.
Speakers set their own fees
Speakera charges a platform fee (percentage of booking fee) for facilitating transactions
Payments are processed through secure third-party payment processors
Refund policies are determined by individual speaker-organizer agreements
Platform fees are disclosed during the booking process and are non-refundable unless otherwise stated.
Cancellation policies are determined by speakers and must be clearly stated in their profiles. Speakera is not responsible for cancellations but may assist in mediating disputes.
Users agree to first attempt to resolve disputes directly. If unresolved, disputes may be submitted to Speakera for mediation (non-binding).
You agree not to:
Violate any laws or regulations
Impersonate others or provide false information
Interfere with Platform functionality or security
Scrape, harvest, or collect user data without permission
Use the Platform for unauthorized commercial purposes
All Platform content, including logos, trademarks, designs, and software, is owned by Speakera LLC or its licensors. You may not use, copy, or distribute Platform content without permission.
By opting in to SMS communications, you consent to receive text messages from Speakera as described in our Privacy Policy. Standard message and data rates apply. Reply STOP to opt out or HELP for assistance.
Speakera LLC operates an SMS messaging program to communicate with speakers and event organizers who have explicitly opted in. SMS use cases include:
Transactional: Booking inquiry alerts, appointment reminders, profile claim confirmations, and account notifications
Marketing: Promotional offers, platform updates, and featured speaker highlights
Messages are only sent to users who have provided explicit SMS consent via our opt-in form. Message frequency varies. Message and data rates may apply. Reply STOP to opt out or HELP for assistance.
Speakera LLC is not responsible for any delays or failures in the receipt of any SMS messages connected with this program. Delivery of SMS messages is subject to effective transmission from your network operator. Message and data rates may apply. Speakera LLC and the mobile carriers are not liable for delayed or undelivered messages.
The Platform is provided "as is" without warranties of any kind, express or implied. We do not guarantee uninterrupted or error-free service.
To the fullest extent permitted by law, Speakera LLC is not liable for indirect, incidental, consequential, or punitive damages arising from your use of the Platform. Our total liability shall not exceed the fees paid by you in the 12 months preceding the claim.
Speakera is not a party to agreements between speakers and event organizers. We are not responsible for speaker performance, event quality, or disputes between users.
You agree to indemnify and hold harmless Speakera LLC, its affiliates, and employees from any claims, damages, or expenses arising from your use of the Platform or violation of these Terms.
We may suspend or terminate your account at any time for violations of these Terms or for any reason at our discretion. You may terminate your account by contacting support.
These Terms are governed by the laws of the United States. Any disputes shall be subject to binding arbitration or resolved in a court of competent jurisdiction.
